Welcome to Nic's Knacks. These Terms of Service ("Terms") govern your use of our website (the "Site"), and your booking of face painting services or purchase of handmade pottery from us (together, the "Services"). By using the Site, booking a service, or placing an order, you agree to these Terms. Please read them carefully before you go ahead.
Nic's Knacks is a sole trader business (ABN - 72 202 197 613) operating from Carindale, Queensland, Australia. We offer two things, equally: face painting for private parties and community events, and handmade pottery sold online and at Brisbane markets.
1. Our Services
Nic's Knacks provides two service lines:
• Face painting for private parties and community events, booked directly with us or through the Site.
• Handmade pottery, sold through our online store and at Brisbane markets.
Information on the Site is provided for general purposes connected to these Services and isn't intended as advice you should rely on for any other purpose.
For safety reasons, we don't paint children aged 3 and under. This applies to all bookings, and we're not able to offer an alternative service for this age group.
Our face painter holds a current Queensland Blue Card (Working with Children Check) issued through Blue Card Services.
2. Intellectual Property Rights
Our intellectual property
The Site and its content, features, and functionality — including text, photos, pottery designs, face painting designs, graphics, and logos — are owned by Nic's Knacks or our licensors and are protected by Australian copyright, trademark, and other intellectual property laws.
You may view and share content from the Site for personal, non-commercial use. You may not copy, reproduce, sell, or otherwise use our designs, photos, or branding for commercial purposes without our prior written permission.
Your submissions
If you send us photos, reviews, or other content (see "User Generated Contributions" below), you confirm you have the right to share it and that it doesn't infringe anyone else's rights.
3. User Representations
By using the Site, making a booking, or placing an order, you confirm that:
All information you provide to us is true, accurate, current, and complete.
You have the legal capacity to agree to these Terms.
If booking face painting for an event, you're authorised to make that booking and to provide consent (including photo consent, where relevant) on behalf of any children attending.
You will not use the Site or our Services for any unlawful or unauthorised purpose.
You will keep your booking, order, and contact details up to date.
4. Products
All pottery is handmade, so small variations in colour, glaze, shape, and size are a natural part of the process rather than a fault. Product photos are a true representation of our work, but slight differences between a photo and the piece you receive are normal and expected.
We make every effort to display colours accurately, but screen settings can affect how colours appear.
Materials used in our pottery and face painting products are set out in our Product Safety & Materials Disclosure, available on the Site. Please check this if you have any allergies or sensitivities.
We reserve the right to limit quantities, discontinue a design, or update our product range at any time.
5. Purchases and Payment
Prices for pottery and face painting services are listed in Australian dollars (AUD) on the Site or as quoted directly to you.
We accept payment through Squarespace Payments for online pottery orders, and through Square for in-person payments at markets and events. We don't hold or store your full card details — payments are processed and tokenised securely by these providers.
Face painting bookings require a minimum 50% deposit at the time of booking to secure your date, with the remaining balance payable as agreed. See our Terms & Conditions — Face Painting and Cancellation Policy for details on deposits and payment timing.
We are not currently registered for GST, so GST does not apply to our prices.
You agree to provide current, complete, and accurate payment information for any purchase or booking made through the Site.
6. Return Policy
Pottery: unused and undamaged pieces can be returned within 14 days of delivery. Return postage is the buyer's responsibility. Custom or made-to-order pieces are final sale and can't be returned.
Face painting: cancellations and rescheduling are handled under our Refunds, Returns and Cancellation Policy, which sets out our refund tiers depending on how much notice is given.

7. Prohibited Activities
You agree not to:
• Use the Site for any unlawful purpose or in breach of any applicable law.
• Attempt to gain unauthorised access to the Site, our systems, or any accounts.
• Interfere with or disrupt the Site or servers connected to it.
• Use automated means (bots, scrapers) to access the Site without our permission.
• Submit false information when making a booking or placing an order.
• Use content from the Site for commercial purposes without our permission.
• Behave in a way toward our face painter or staff at an event that is abusive, unsafe, or puts anyone at risk.
8. User Generated Contributions
From time to time, you may be able to submit content to us, such as reviews, testimonials, or photos from an event or of a purchased piece ("Contributions").
Contributions must be accurate, respectful, and must not infringe anyone's privacy or intellectual property rights. If a Contribution includes a photo of a child, we'll only use it in line with our Photo/Image Consent Policy and with appropriate consent.
We may, but are not obligated to, remove or refuse to post any Contribution that breaches these Terms, at our discretion. This is separate from your right to request removal of your own Contribution — see Section 9.
9. Contribution Licence
By submitting a Contribution to us, you grant Nic's Knacks a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that Contribution — for example, on our website, social media, or promotional material — for purposes connected to promoting and operating our business.
You retain ownership of your Contribution. This licence doesn't affect your other rights over your own content, and you can ask us to stop using a specific Contribution at any time by contacting us.
10. Third-Party Websites and Content
The Site may link to third-party websites, including our Facebook and Instagram pages. These links are provided for convenience only, and we don't control or take responsibility for the content, accuracy, or practices of third-party sites.
We don't run advertising pixels or tracking embeds through our social media links. Visiting a linked third-party site is subject to that site's own terms and privacy practices, not ours.
11. Services Management
We reserve the right, at our discretion, to:
Monitor the Site for breaches of these Terms.
Refuse, cancel, or limit any booking or order, including where we reasonably believe it breaches these Terms.
Manage the Site to protect our rights and property and to ensure it runs smoothly.
Remove or restrict access to content that breaches these Terms.
12. Privacy Policy
We care about your privacy. Our Privacy Policy explains what personal information we collect (including sensitive information such as allergy or skin sensitivity details provided for face painting bookings), how we use it, and your rights under the Privacy Act 1988 (Cth). By using the Site or our Services, you agree to the collection and use of your information as set out here, in our Privacy Policy.
13. Terms And Termination
These Terms apply for as long as you use the Site or our Services.
We may suspend or terminate your access to the Site, or decline to provide a Service to you, at our discretion — including where we reasonably believe you've breached these Terms, engaged in unsafe or abusive conduct, or provided false information.
14. Modifications and Interruptions
We may update our product range, pricing, availability, or Services at any time without notice.
We may also update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date, and continued use of the Site or our Services after changes are posted means you accept the updated Terms.
We don't guarantee the Site will always be available, uninterrupted, or error-free, and we're not liable for any loss arising from downtime, maintenance, or technical issues beyond our reasonable control.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms or your use of the Site or our Services is subject to the exclusive jurisdiction of the courts of Queensland.
16. Dispute Resolution
If you have a concern or complaint, please contact us first so we can try to resolve it directly and in good faith — most issues can be sorted out this way.
If we can't reach a resolution, either party may refer the matter to the Queensland Civil and Administrative Tribunal (QCAT) or another appropriate forum in Queensland, without limiting any rights you have under the Australian Consumer Law.
17. Corrections
The Site may contain occasional typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, or other information. We reserve the right to correct any errors and to update information at any time without prior notice.
18. Disclaimer
The Site and our Services are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties, express or implied, beyond those that can't be excluded under the Australian Consumer Law.
As handmade items, our pottery pieces will have natural variation in colour, glaze, and shape, and are not guaranteed to be identical to photos shown on the Site. Please handle ceramic pieces with care, as they can chip or break with impact.
Products used in face painting are chosen with skin safety in mind, but we can't guarantee against allergic reactions. Please tell us about any known allergies or skin sensitivities before your booking and see our Product Safety & Materials Disclosure for ingredient information.
19. Limitations of Liability
To the extent permitted by law, Nic's Knacks will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site, your booking of face painting services, or your purchase of pottery.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, including your rights in relation to faulty or not-as-described goods and services.
20. Indemnification
You agree to indemnify and hold Nic's Knacks harmless from any claims, losses, or damages (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your provision of false or misleading information in connection with a booking or order.
21. User Data
We'll maintain reasonable data related to your bookings and orders (such as contact details and transaction records) for use in operating our business, including to meet our record-keeping obligations to the Australian Taxation Office. You're responsible for keeping your own copies of any information you consider important, as we don't guarantee against data loss.

22. Electronic Communications, Transactions, and Signatures
By using the Site or booking our Services, you consent to receiving communications from us electronically, including emails and messages relating to your booking or order. You agree that electronic communications, agreements, and consents (including deposit confirmations and consent forms) satisfy any legal requirement that such communications be in writing.
23. Miscellaneous
These Terms, together with our Privacy Policy, Refunds, Returns Policy & Cancellation Policy, and other policies referenced on the Site, make up the entire agreement between you and Nic's Knacks in relation to your use of the Site and our Services.
If any part of these Terms is found to be unenforceable, the remaining parts will continue to apply. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. You may not assign your rights or obligations under these Terms without our consent; we may assign ours as part of the ordinary operation of our business.
